  • For a Hudson Valley land trust, assisted with preparing a successful application for accreditation by the Land Trust Alliance Accreditation Commission.
  • For a petroleum distribution company, negotiated two global compliance orders with New York DEC related to compliance with bulk storage regulations.
  • For a golf course management company, resolved a dispute between owner and operator regarding Clean Water Act compliance and worked cooperatively to ensure ongoing compliance.
  • With John E. Osborn P.C., submitted comments on the proposed Memorandum of Agreement between the New York State Department of Environmental Conservation and the Mayor's Office of Environmental Remediation for the New York City Brownfield Cleanup Program, resulting in helpful clarifications of the agreement.

Project Awards

A number of the projects Pennington worked on at his prior firm have received national and local awards:

  • The Rheingold Gardens project (redevelopment of a brownfield property in Brooklyn for affordable housing) won a “Phoenix Award” at the national “Brownfields 2005” conference in Denver, Colorado. Pennington assisted with site acquisition, financing and insurance matters, preparing restrictive covenants, developing plans for post-remediation operations and maintenance, and preparing disclosures to potential home buyers.
  • Two of his projects were awarded New York City Brownfield Awards, by the New York City Brownfield Partnership, at its second annual awards ceremony in June 2010. The awards recognize “the most remarkable brownfield projects in New York City.”
  • The IAC Building won the Green Building Award. Pennington advised InterActiveCorp in environmental issues during construction of a new Frank Gehry-designed headquarters in a re-emergent neighborhood in Chelsea in New York City. Services included negotiation of a Brownfield Cleanup Agreement, remediation contracts, and environmental insurance and development of post-remediation site management plans.
  • The American Airlines Terminal Redevelopment at JFK International Airport won the Environmental Protection Award. Pennington counseled American Airlines in negotiation and implementation of a fast-track consent order for remediation of contamination at JFK Airport in tandem with construction of a new terminal.
